So me & my son's father live with my parents. We don't pay rent but help them with some of the bills for light,gas & cable. We constantly fighting so when I want him to get out (bc he has a drinking promblem & after effects) he says he won't leave until my parents pay him all that money back. The 2 bills are under his name but only because he needed proof of addrss at the time. Can he sue my parents for that $$ back? Will he win?

Anyone can sue for anything. But no, he will not win. He received value for what he paid, use of the utilities, a roof over his head, etc. So there is no reason for reimbursement.

I wouldn't bother going over what it costs. However, he is a resident and your parents have to got through the process to get him out according to the laws in your area.

He can sue but liley will be wasteing time and money. Just evict him following the laws in your state. Where do you live?

You parents can you just give him written notice to move, and if he does not then you file in court to evict him.

In fact your parents can start charging him and you rent if they wanted to, with a 30 day notice.

I live in the state of NY. The way my parents c it is they don't charge me rent being I am their daughter & I'm the only 1 who can help them pay for cerain bills. But as far my son's father, he not on a lease at all or anything & we're not married. He just unappreciattive of things. Thanks guys for your support & response.

They don't have to charge you rent for you to be considered a tenant.. So if they want him to leave, they do have to go through the legal process for an eviction if he refuses to leave.

But if he thinks he can get reimbursed for what he has paid, its not going to happen since he got value (a roof over his head) for what he paid.
