No it is not illegal for a male to search a female if there is no other choice and an arrest is being made. ( or other officer safety issues)

Judges seldom have "mercy" but you can submit any pleas in the summary for the sentencing investigation

First no it is not illegal for the officer to search a woman. If that was the case all the criminal would have to do is have the female carry everything. As a practical matter he will ask a female officer to do the search but he is under no obligation to do so. As far as the judge showing mercy because you had a time interval between your third and fourth arrest no he will make sure you do your best to avoid number five!

Sentencing is not guesswork, unless you live in Texas... Your state most likely has the probation department prepare an in depth sentencing matrix based on a pre-sentence interview they'll do. In some states, that matrix MIGHT give you credit for what's called an "ancient" conviction, assuming you had long periods of criminal free conduct in between.

What does your term "a long time" actually mean in years? 10, 15, 20 as they will be deemed ancient after 20 years vs 5 years. What you think is a long time may not be long enough.

And yes, a male officer may frisk you to see if you have any concealed weapons or more drugs, etc. Perfectly legal.
