Hi,

I am a step-parent to a 14 yr old boy in the state of DE. I also have two children of my own with my husband. I have been supporting my family for 2.5 years by myself. My husband is not working and my step sons mom has not offered to support her son since he has been living with me. Can I file for child support being the step parent? The child's mother lives in GA. Custody papers are filed there with only my husband's name on it for the child to live in DE with my husband. The child is now 14 Yrs old and getting more exensive. When the child lived with his mother my husband paid a large sum of child support. He refuses to file support against her. What are my options?

No, you are just the boys fathers wife, and have no legal rights what so ever to the boy. If you want support filed your husband has to file it.

Can he qualify for welfare? Then the state would file against her.
