It will depend on the type of debt, when the last payment or last date of activity was on the debt. Who the debt is to, IRS or Sears?

Also have they gotten a judgement and perhaps even renewed a judgement.

So while I have to say deends most likely they can not take you to court at this point.

Are your repsonible to pay, of course you are, it is debt, nothing takes away legal responsibility or the fact you owe them.

Nothing takes away the moral obligation to pay debts you owe.

Nothing stops them from trying to collect the debt under every legal statue they have.

But if the Statue of Limitation has ran out, they can no longer take you to court and do legal action against you to collect.
