Where do you live? He can't charge you with kidnapping unless you leave the area or hide while there is a court order of shared custody or visitation. If you are going to leave with your son, go somewhere where there are people to protect you, not alone. Don't hide your location from him. Leave a note or have them come get you. First option is to look for support groups in your area for abused wives. They can provide advice and maybe legal help. If you can't find one, then go see a lawyer.

While I'm not familiar with Netherlands law, I very highly doubt that you can be charged with kidnapping by taking your own child. But I also doubt if you can leave the country with the child without both parent's permission.
