I am planning on purchasing a 1991 mobile home set up in a park in New York State. The owner states that there is no title and they have no Bill of Sale. What documentation is needed to purchase this home without facing any difficulties regarding ownership down the line.

If they have no title how do they intend on selling this to you? Also the home must be registered with the county so the homeowners pay taxes each year on the home. I'd go to the county tax auditor's office and see if this home is even registered in the county and ask them how would you go about getting the home transferred into your name. They may refer you to the DMV after giving you the S/N of the house so they can check out who is the owner.

I wouldn't buy this home unless I would have a clean title in the seller's hand ready to hand to me with my name on it.

Beware, Dan, of this seller as I don't think they are on the up and up on this deal.

You might also want to check with the Park Manager to see if they have any documentation on this home. Some parks insist they get a copy of the title to a home for their records in case the owner abandons the home and must notify the lien holder.

Prior to 1995 title's on mobile homes were not required, this is why there is no title. Regarding the taxes, the home is in a mobile home park, where th owner of the home pay only a lot rent. Thanks

Has the county told you this? Mobile homes aren't subject to the property tax? Interesting.

That is correct on the property tax, as for as land is considered, but they fall under personal property tax normally, and/or tax like that paid on your automobile, many places have annual stickers that must be purchased.

But even without a title to the home, there has to be a bill of sale. Where they bought it, and/or a court record if they took it for unpaid rents.

Here in Ohio I pay lot rent AND a real estate tax on my MH to the county. Please double check with the county as I would be really surprised if there are NO taxes on each individual MH paid by the owner of the home. Sure the park owner pays real estate tax but that is on the LAND. Please check again. In Florida I had to buy stickers for EACH side of my double wide each year or pay a hefty fine and buy the stickers besides.

Who said that there were no titles prior to 1995? I find this hard to believe. Also check with the county as ANY mh that is placed in a county in Ohio MUST have permits issued and the county notified of the placement for tax purposes. The house movers must have permits or they cannot legally travel the roads in any state.

Please check again.

I too find this most interesting a;sp as the county is NOT about to forego more revenue.
