View Full Version : Applying to adjust status while in removal proceedings

Hello,
I'm trying to apply for adjustment of status (form I485) based on an approved petition filed on my behalf by my wife back in 2008. I came to the US in 1994 on an F1 student Visa and overstayed it. I'm married to A US citizen and have four kids with her. My problem is back in 2010 my wife and I just couldn't get along anymore and in Dec of that year we had an argument that went bad and I ended up getting arrested. Afterwards, Ice caught up with me and put me on removal proceedings. I'm due to got to immigration court in May of next year. My question is: Do I send my application to the court? How about employment authorization document or EAD do I file that too to the court? I do need one since I have to take care of my kids(I'm unemployed right now, hard to find a job with E-verify). Also, When filing the I130 petition three years ago I also filed I864 sponsorship documentation and G325A biographic information, Now do I have to file those again with I485? And If and when I file do I have to wait for my court date in order for them to approve or deny my application? Any thoughts on these questions? Thank you very much and I appreciate your help.
