My boyfriend is on probation for domestic violence and while knowingly he was in class yesterday 6/28/11 his probation officer came over, and started to drill me a person who never been in trouble with the law. Going threw my things as well as his. It felt like she was trying to get me to say something to get him in trouble. She knew my boyfriend mom let me move in due to a bad situation and that we have different rooms but his things are still in his old room which is my new room so I can be closer to my kids rooms. I am really scared right now that I may loose my boyfriend and its some how my fault. My question is can my boyfriend get a probation violation for just having sex?

Your boyfriend is subject to search at any time... YOU aren't... Your boyfriend MUST answer their questions. YOU are NOT required to... Here's what I would do... Separate YOUR living quarters from HIS. Keep YOUR room locked and do NOT give him a key.

Now, IF the PO comes again, DO NOT TALK TO HER, and DO NOT LET HER INTO YOUR PRIVATE LOCKED SPACE. You can't stop her from breaking down the door, and she might do that because they don't like to be challenged... But, if she does, you can SUE for damages, and anything she finds CAN'T be used as evidence against YOU or your boyfriend.

We have looked at his court papers regarding his po and its said nothing about being in a relationship or having sex. I don't understand how a po can control that aspect of his life. But I have yet to hear from him since 1130 so I guess I should just assume he has been violated right? Its 1:16 now

If you've looked at his papers and it doesn't preclude him from a relationship, then if he IS violated for this phony charge, then it won't be sustained... But, at this point, I wouldn't assume ANYTHING.. Wait till you hear from him..

As long as you are not on probatoin or parole. If you are on probation or if you were involved in any way or form in his first sentence, they can control it.

Example, my son was on probation, he can not live with or even associate with anyone else on probation or parole ( about 1/3 of Georgia) without PO permission.

His girlfriend was on probation, he ended up going back to prison for dating her ( not even living together)
