Here's the situation:

Driving from NJ to Las Vegas, friend gets pulled over in Kansas for speeding and seatbelt violations. Bigger problem, his license expired last month. Cop gives him 3 tickets, and then confiscates his drivers license, saying I should drive.

Is the cop allowed to confiscate his license?

What would be our best course of action considering the circumstances?

You drive the rest of the way.

Your friend should

pay the tickets; and
Renew the driver's license.

As far as confiscation of the expired license is concerned, seems unnecessary, but what does it matter?

Is the cop allowed to confiscate his license? Hello K:

He has NO license.. It expired.. What he had was a piece of paper that represented NOTHING. So, I don't know why you're upset that he confiscated it.

Last time they renewed my license, they also gave me an ID card at no extra charge. Seems like a good idea. That way if some cop decides to confiscate the license for some inexplicable reason, I will still have photo ID.
