I have delegation of powers by parent or guardian for my grand daughter while my daughter is in jail and the father is trying to take her. Does he have the right to take her away from me even though he has yet to be proven the father and if or when he is does he then have the right ? Please help me what are my rights?

Yes, he can, assuming he is able to prove that he is the father. Your daughter, through an attorney, should immediately file for custody, specifying that any such custody will of course be delegated to you while she is in jail.

Did the daughter ever file and get a order of custody ?

I will assume father is not on birth cetificate ?

Has birth father asked for a DNA test ?

You seem to know he is the father? So why would the peson you seem to agree and admit is the father, should not have the children
