View Full Version : I have a bench trail, for credit card debt, what do I do..

Well I was given back in feb, a citation saying that I was going to be sued by {TMI} a third party that bought my debt, (2641.65) {TMI} is the one representing them. I live in Texas so that you know this off hand. I did take the last part where I admit or deny the stuff, and I denied everything and sent it off to them via mail and fax. A little back story about this debt. This started as a low income credit card for students, had a low interest rate and I was making payments on it just fine, I used it for mainly school items, text books and such. Then within 5 month time span it was bought out by 4 other financial company, thus ending up with bank of america, and the intreset rate alone raised the 1200 debt that was on the card that I was making payments on, to which I have no clue where they even went since it switched so many times, I managed this all online, and ending up where I am today.

Well they are suing me from a breach of contract and want the full amount. It was stated that they sent a letter out in October asking to settle I never once gotten anything from them to settle this matter. I am a single mother, and any money that that I do get I use on my son, I am a full time student as well, and do not work, this card started when I was 18 now I am 24, you can do the math. Also the card was closed and went to zero after it closed. I didn't even know the card closed and I was still sending payments, where they went I have no clue.. This is at the same time I found out that another bank had bought the card, thus me finding out bank of america now owned the card. I never received anything in the mail telling me this, and never got a new card. Don't even get me started on the harassing phone {TMI} at odd hours of the day, and to my cell phone, to which they didn't have the number to start with, which doesn't surprise me that they found it anyway.

I have researched this company and have read that they are they scum of the earth, I can see that this is so true. If I have to go to court I have to bring my son since I am his care taker.. I can't afford a lawyer and just want this matter solved, my question is what do I do next?

So you go to the hearing, you demand verification of the debt. Present any evidence you have that the debt balance was zeroed out. Either that or you try to arrange a settlement.

And no do not take a child to court, it is considered very unprofessional and will go against you.

Take proof of the payments you made, the cancelled checks would show who cashed them. First of course deny owing the debt make them prove you owe it.
