Good morning,

I'm French, I've been in the US (NYC) in 2007-08 as a teacher with a J1 visa. I left the country in July 2008. In August 2011, I will come back (in California) to work again as a teacher with a J1 visa. I have a SSN.

I have a Bank Of America account in NYC and I want to open a new account online. But I need to check a box saying that "I am a US citizen or a resident alien" (to verify that I am not subject to backup withholding from taxes). However I am a non-resident alien (J1 Visa). I've spoken with the customer service and they told me that I can check it because, with a SSN, I am not subject to this backup, no matter my status.

I hesitate because it's written that I could be subject to penalty of perjury if it's not true.

Do you think I may follow the customer service representative advice ?

With J-1 visa, you are eligible to obtain SSN for tax purpose. The customer service is correct.

Check it, but mark with an asterisk, then annotate to show your J-1 NIV status.
