My boyfreind has been staying with me for about two months and we were in an argument when he pushed me and now I want him out. WHAT ARE MY LEGAL RIGHTS ?

My girl friend asked me to live with her so I moved in. now we had a fight recently and she wants me out. I have no where to stay at this moment but eventually I will find a place.I don't have the money to just up and leave just yet. Can she put new locks on the door to keep me out and toss my stuff out of the apartment ? What can I do ?

No, You are her tenant and she is your landlord. She has to give you time to move. However, what the law requires of her depends on several factors. First, ANY question on law needs to include your general locale as laws vary by area.

Second, do you have a lease? Were you paying rent?

She has to give you written notice to terminate your tenancy. This notice can be anywhere from 14 to 60 days depending on factors.

She can definitely not change the locks on you or throw your things out. This would constitute an illegal eviction and open her up for a lawsuit.

Except, since he used violence (by pushing), you have the possibility of getting a domestic violence restraining order, requiring him to leave immediately.

I could be wrong, but think we have two different situations. I don't recall, but I believe there were two different OPs. One had a BF and the other had a GF. I noted that they seemed to be flip sides of the coin, but didn't mean to imply that they were actually the same couple. So the threads were merged.

On the other hand, it now appears that they were the same OP, "r_denne". So now it's really confusing. Sorry.
