I met my fiancé when I was 3 months pregnant.he was there entire time and for the birth of my baby girl whom he feels like is his.the birth father is unknown so no one is listed on birth certificate as father.can my fiancé adopt her?

You would have to sign an affidavit that you have NO idea who the father is (not just that he's not on the birth certificate). If you lie, it's a crime; if you lie the father can always appear and cause all sorts of trouble following an illegal adoption.

Your fiancé needs to be your husband before any of this can happen.

If the father is out of the picture, why not just ask him to sign?

I was going to just have him sign but was told that would be fraud.We just wanted to make sure if we would have to wait until we are married first. Thanks for the help :)

If he is not the birth father and signs that he is, yes, it's fraud... and a crime.

ANY question on law needs to include your general locale as laws vary by area.

In most states you need to be married for a period before filing for the adoption.

Were you raped? If not then the father is not completely unknown. You may not know which of multiple potential fathers is the right one, but you should have an idea of who the potential father is.

You will be required to name all the potential fathers and they will have to be informed and tested before the adoption can be approved. Start shopping around for an attorney now.

How can the birth father be unknown? Isn't there some idea of who it might be even if it's a list by elimination ?
