View Full Version : Can probation for DUI be transferred from TN to OR?

Last night my fiancée got arrested for a minor accident- his BAC was .21 but damage was incredibly minor- 2 busted lights. He's supposed to be moving to OR from TN on the 24th of June where he has a job and we have a signed lease for an apartment... if he stays in TN he won't have a job nor a place to live. Court date is June 15th, he is still in possession of his license and did not actually receive a ticket last night, nor had to post bail this morning to be released.

Questions- What are the possible consequences aside from getting his license suspended? (which I am sure will happen)
Would he still be able to move even if he is put on probation?
Can he face jail time even though it's his first offense and the accident was minor?

Any help at all is appreciated, we need backup plans in case he isn't allowed to move to Oregon...

He obviously has to come back to appear in Court - if he leaves.

No way of knowing what the sentence will be - hopefully if he has a clean record he will not do jail time. Of course, if his license is suspended in one State suspension is honored in another.

He first should have an attorney, and has to appear in court.
Next if he has to "appear in court" then he was given a summons of some type to appear
After that, he has to make it very very clear that he has moved and needs his probation in his home state.
With an attorney, he may make this a plea deal.

He has the plastic card that is his license, that does not mean it is valid. But along with it, there wlll be a time it is suspended for the DUI
