I wanted to set up 501 C3 Non Profit ORganization in US. Objective is to work for underprivileged and needy. I am currently on H1B visa in US.

Can you ***. Let me know if I can set up this Non Profit legally in US while on H1B visa ?

I think you can.. I've looked at the IRS publications and you just need 3 principals; I see no requirements about them being citizens. But when does your visa expire?

As far as what immigration will allow, especially as it relates to any employment requirement, I don't know, and they will watch what you do. You haven't even said what country you are from.

You have to maintain full time job with employer who sponsors your H1-B. You can be 1 of 3 principals to set up 501 C3, but there is no guarantee that it would help with your status after H1-B expires.
