What are my rights if management entered my apartment without my permission to place a eviction notice in my apartment for failure to pay rent, when in fact, they had my payment prior to entering my apartment. They claimed that they had misplaced it in the office.

I don't know what you mean by "rights." What does your lease say about management entering the apartment? Is it allowed, do they have to give advance notice, is it under emergency conditions only?

What have they done about the eviction? Cancelled it IN WRITING, something else?

I don't know where you are or how your lease is worded BUT it certainly seems that they overstepped their boundaries and I'd probably be very upset.

I just don't think if you are talking about legal action that you have been damaged to the extent that you have a claim. I'm not sure, in fact, that you've been damaged at all.

First they cannot place an eviction notice until a court grants them one. This was probably a notice to vacate. Second was your payment late at all?

Do you have a receipt prior to entry?
