View Full Version : Can I file abandonment?

I have a 4 year old son, his father has not had any contact with me in 3 months, he has also changed his number and moved, we have court ordered support, but he has not made any payments ever! We are currently awaiting a court date to establish visitation. He has been in and out of prison his whole life, I fear for my child's safety when he is around. Is it possible for me to file abandonment? If not, what should I do to revoke his rights to my son?

Abandoning a child is the same as leaving it at a bus stop with no supervision. Your "ex" did not abandon the child. Please read this which is posted at the top of this forum: https://www.askmehelpdesk.com/family-law/child-abandonment-read-first-364259.html
You cannot revoke his rights. You CAN request no visitation or supervised visitation if you can PROVE he's a danger to the child. You can take him back to Court for contempt and get the support order enforced.
Did you know he was in and out of prison his whole life when you conceived your son?

No, I did not until he was arrested and sent to prison during my pregnancy. That is when I found out about his past. He spent the first 2 years of our son's life in prison.
