The father of my daughter is Bi-polar, He is not taking his meds. My daughter has been diagnoised with Bi-polar now and he is refusing her meds when he has her. The Dr. told me if she does not get them consistently that they will be useless, He also stated that if it doesn't get under control now that when she hit puberty that its going to be pretty bad, hospitalization. Her father also is very manipulative with her making her believe the meds make her sick ( they do not) and tells her horrible things about me. Can't him not being in the correct state of mind be considered for unfit and not giving her the medication she needs

And oh yea I just found out his roommate is a registered sex offener

Yes. Go back to family court. You can even file for an emergency hearing before her next visit. I would.

First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

Whether it qualifies him as unfit or not will be up to a either a court of children's services. What you left out of your question is what do you want to do about it? Do you want to terminate his rights, terminate his visitation or what?

In any case, you need to go back to court. I would petition the court to suspend the visitation order or, at least, make visitations supervised. But you need to have proof that he isn't taking his meds and not giving her her's. More importantly you need to go to court before his next visitation because, until the court orders a change, you are required to obey the visitation order.
