I received a summons for a loan that I haven't made a payment in over 3-4 yrs. because the orig loan office told me to pay 20-25 and my account will be considered paid in full, instead they got a new boss, who sent me to a recovery center. The R.Center sent me a letter stating to contact them in 10 days or they will presume other collection activities. I called them ASAP, they did not know about the agreement made between me and the Orig. office, they told me I may need to contact them, but they will need me to send in a payment. I also gave them my # and my husband's so they could contact me. I didn't get no other calls. I and my husband called the orig. office and they stated I haven't paid no payments since 2008-2009, and that they have no reports stating what I was told. I told them If I knew about this debt I would have paid it off already. I did move but, put in a notice w/ the post office. So I could get my mail @ my new address and let all business know. Now, they said I needed to start making what I can in payments, I have no job and could only send 1.00 m/o on 3-21-11, then I got a summons in the from the police stating I defaulted on my account from the recovery center, this was filed on 3-23-11 and they cashed my m/o, because my balance was 109.58, before summons now it is 108.58 plus 101.00 fees, What is the SoL in Ga. and can they do this if I'm trying to send payments, eventough I would have paid it off along time ago, if I knew I have lived @ my new address for over 2 yrs and they just know contaced me. Please Help.
