I was returning an item in which my boyfriend was caught for steeling from another store and then the store I returned it to called the cops they have me on camera for returing it and then the cops came and gave me 9 form and told me to go to court and that I was being charged with fraud I have never in my life done anything except had a speeding ticket what is going to happen to me or what should I do ? Please help me out thank you

It's not illegal to return a stolen item. Hire a lawyer.

Apparently it is illegal to return a stolen item weather you know it iis or not ! Cause they want to charge me with fraud! And he was suppose to get me off with it by giving information to a cop and now I have tog o for finger prints and photos and go to court the next day ! He says his lawyer will stand up for me and say I knew nothing about it and that he(being my boyfriend ) willtake the charge if they drop mine is that even possible :?please tell me what am I suppose to do about this? To make matters worse my boyfriend is now is custody on more charges and he can't meet with the cop and I can't even visit him cause there is a no communication band put on us ! Apperently there is a way around it so I can visit him but I have no idea how to and they also won't let me leave money for him because of it ! What do I do ? Please help me out thanks scared

Hello s:

What I said above is true... That doesn't mean the cops agree. They probably don't... It doesn't matter... They have to PROVE you stole it. You don't have to prove you didn't. Don't say anything. Relax. You'll have a lawyer appointed to you... Tell him what happened.

I'm reading this this way:

Your boyfriend was caught stealing an item from one store (why did he have the item in his possession after being charged with stealing it?);

You attempted to return that same item at another store following his arrest;

He is in jail and there is a ban forbidding the two of you to have contact. (That's pretty unusual for a stealing charge - what else was he charged with?)

Is this right?

My boyfriend stole the item and then we went and returned the item right away and then later that night he was arrested then they came to my house with a form 9 and said I was being charged now he is in jail on other charges as well for pretty much the same thing he has a total of 9 charges breech thefts and assult so yes he calls me and says his lawyer will get rid of my charges and my boyfriend will take the charge if they drop mine can that happen could they do that and if so what happens with my finger prints and photos etc what do you think they will do to me

More questions - when you said you returned the item do you mean you took it back for a refund OR you took it back and said, "Here, we stole this."

You changed your story - at first you said you were returning the item; now "we" were returning the item. Which is it?

The DA decides who will be charged and who won't be charged. Their decision depends on all of the proof. Your boyfriend at this point has little to lose (with that many charges against him) so what he has to say may mean little.

You need an Attorney.

OK I said we returned the item received a gift card with what that item was worth and then the store that we returned it to knew it wasn't there's so they called the cops and then when they looked into it seen that he had stolen it from shoppers and then they knew I returned the item they only knew I returned it cause I had to show my id inorder to get the refund! But I never knew my boyfriend had stolen the item he lied to me and told me a relative gave it to him and said that he needed the money for it since he didn't need the item and the store we took it back to needed to have id shown and since he didn't have his on him he couldn't return the item so he asked me to do it and me being very foolish I listened and did it so now what can happen ? I live in ontario canada so if you can help me in anyway that would be great thank you

No no OK My boyfriend was caught steeling the item but not until later that night once the store we returned it to figured out it was from another store and called the cops and when they looked into it they went to that particular store and see the cam with him taking the item but once he got the item and at the time I never knew it was stolen cause I went to pick him up at his place we went to return it he told me someone in his family gave it to him and so once we got to the store he had realized he needed his id and didn't have it so I had mine and I went into the store and returned it and showed my id and that is how they charged me into all this and so later that night they came to my door and they had him with them and gave me a form 9 and said I was being charged with fraud under 5000 but apparently he was suppose to give the cops info to something and they said they would drop my charges if he cooporated however that never happened soooo what is going to happen to me I'm in the process

Of trying to hire a lawyer but I don't have all the funds for this I can't afford this especially now I have to kids and one on the way please help me

I would go to Court and ask for an assigned Attorney (if you can prove you cannot afford one).

I find your story to be very disjointed. It is difficult to believe that you were a totally innocent party. That's why you need an Attorney.

I don't understand the "no contact" order and you didn't explain that - as I said, that's highly unusual under these circumstances.

You need an Attorney.

They no contact order was for him and I but because we have a child we can meet at another place besides my hom residence and he can't call my hom number he is to reach me on my cell and meet me at another location this is cause I live with my parents and they want nothing to do with him ! And yes I was totally innocent on this particular matter I had no idea the item was stolen now did I believe it could be stolen YES did I know for sure he stole it at that time NO I guess I need a lawyer

So the no contact is between your parents and your boyfriend?

You don't have to convince me. You have to convince the Court.

Your best bet is to request legal counsel when you appear. However, if you live with your parents and they have the means to provide you with an Attorney you may not qualify for free legal assistance.
