I was in USA for 5 months in 2010 on L1 visa.
Now I am in india. On W2 form Taxable marital status is 'married'.
Along with W7 form to get ITIN for my spouse which form I need to submit to get the federal and VA state tax return?
I am confused between forms ----1040NR and 1040 NR-EZ.

Please advice.

First, know that you have until 15 June 2011 to file; because you are overseas, you egt an automatic two-month extension.

File Form 1040NR with a Form 2106 to claim daily living expenses (rent and utilities, food, local transportation, incidental expenses). The Form 2106 is permitted because your work tour was LESS than one year in length.

You may also have to file a state tax return.
