View Full Version : Help.. how do I get my 3 siblings to sell my dads estate as he wanted?

I have 3 siblings and our father died 1 1/2 years ago. He did not leave a will but has a large amount of vaaluable personal property. Our dad told us to sell everything when he passes. My siblings do not want to sell anything ,is there a way to force a sale and honor a fathers wish so we all can move on.

You might have a chance if you had some proof, written usually, and a good lawyer to sue your siblings.
(And you would be amazed at how many versions of a deceased person's wishes there are. Some are even true - the parent told different things to each child.)

Wait, I'm still drinking my coffee and doing chores.. an heir might be able to force partition on property that isn't divisible. What is the status of all the property and what type is it, and where did he live?

You can file a probate petition and apply to be personal representative. The PR would have the right to administer the estate, including selling the assets, so as to effect the provisions of the intestacy statute in your state.
