I am still using my ex husband last's name as my legal name however I am now expecting my first child and the baby's father is not in the picture. I would like to know what last name I should give my child? My maiden name (which is I don't use) or my legal name (which is my ex husband's name). Thank you!

You can put your maiden name, or the baby's fathers name. Is your ex husband the baby's father? If not, you may want to stay away from that given that you know who the child's father is. But its not illigal to put any mans name on there. But if its not the father, the bio father may make trouble later about paternity.

Jennie, it IS illegal to name someone who is not the father on the birth certificate.

I was told you can put any name. Your name, your husbands name, the child's fathers name. Or even someone who isn't the father. The only thing that can stop it is if the biological father files for paternity and proves that he is the father. Until a paternity test is preformed, there is no proof who is the father and who is not. I had the option of leaving it blank, using my name, or her fathers name. And I have known mothers to put their husbands name even though the husband isn't the child's father

I don't know who told you this and in what State but it is a felony to list a person you KNOW is not the father on the birth certificate in my State (NY) and many others.
