View Full Version : My partner didn't have a will who will gets his money if it under '2000?

I just lose my parnter of 11 yrs (killed him self) we wasn't married, so I understand that's he's mother is next of kin (although they didn't really talk to each other) she has arranged he funeral etc and would not help me arrange so everything was done to how she wanted it, which as well I understand due to gulity losing a son etc, she has told the cononer (as there is an inquest) that he lived with her, he has not lived with her for 11 yrs, he has stayed with her for a few nights here & there when we had our downs as everyone does, he lived with me and our 2 children, is she allowed to tell the cononer this, and she is now asking for detail of he bank accounts and stuff, because she has applied for a funeral payment of the social fund, and is telling me that what money he had needs to pay for the funeral, he didn't have much in the bank about â£800, but I thought you wasn't allowed to get a funeral payent unless the person lived with you, and also I thought that any thing of vaule would go to our children. So advice in this matter is really needed, but don't know wo to go to, because this is a very sad time, and don't want to upset any one even more... *** help!!

This will be decided by probate.
Normally will go to the next of kin, so if you weren't married there could be a problem there for you.

Marriage is the document YOU needed to memorialize your rights, but simply being his children is all THEY need. Depending on where you live, I'd say his children are his next of kin.
