The person that I am asking about got his 3rd dui in November 2010 (yea what an idiot) about 2 1/2 weeks prior to getting off probation for his second dui. After getting his 3rd dui, he was released from his probation as scheduled in November 2010. He went to court about a week ago for this 3rd dui, the judge sentenced him to a year in jail but suspended all but 30 days. Now they have reopened his probation (for his 2nd dui) and he is now going to have to court in April for violation of probation. Does this mean that he will have to serve the full year?

It will not effect the new sentence but they can make him serve all the probation time from the last probation.*** you did not tell us how many months probation he had, that is the possible jail time.
