I think you mean a 'registered' sex offender. No, I don't think any judge would let him have custody of children, even his own children.

It depends on the details of the sexual offense(s) for which he was convicted.

What offense occurred and was it involving your children?

Yes they can, if the sex offense has nothing to do with children and the court would believe that his children have nothing to fear.

For example if the offense was when he was 17 and he had sex with his 15 year old girl friend, then the court will or should have no issue with it.

If it was because he was urinating in public, there should be no problem.

So without more details not possible to tell
