View Full Version : Roommate not on lease and I have given my notice

I live in Florida. My year lease ran out on February 28, 2011. I paid February rent. I am moving out tomorrow. The landlord has my security deposit for last month's rent. My boyfriend, who is not on the lease and legally lives in his old house (gets all his mail there etc) will not leave. Please let me know two things. First, do I have to give him any notice to move out? Second, do I have to let the landlord know that he has refused to move out? Third, if I move out and he doesn't will I still be responsible for any rent past March (which will be paid with my security deposit.) What are my legal responsibilities and rights. Thank you!

You have allowed boyfriend ( or is it ex boyfriend now) to liv there, so you may have liability for rent till boyfriend is evicted, since you have the rental, not boyfriend,
Next until the house is empty and the owner takes it back, there is no deposit to give back since he has to wait till either boyfriend will rent from him or moves out

You did most everything WRONG here, and you picked the WORST state to do it in...

Yes, you need to give notice. Yes, you'll be responsible for the rent as long as your boyfriend stays. NO, the deposit wasn't for the last month. It was to protect the landlord from damage you might do.

Do you have to let the landlord KNOW that your deadbeat boyfriend is planning to stay?? Are you serious?? Girl, you are setting yourself up for a BIG letdown. First off, Florida requires 60 days notice.. So, right now, TODAY, you're responsible for March, April, and May's rent, and I don't know HOW much damage so and so is going to do after you go...
