Hi, my fiancée is a usc I am a ukc, I proposed to her whilst visiting her last and leaving her is extremely hard. I was planning on coming over on the k-1 visa originally but then I remembered her birthday was at the end of march and her desire for me to be there for that. So I was wondering if I could get married over there whilst on the vwp due to not really wanting to wait for the k-1 to be processed. I read online about not being able to change the status of the vwp so was originally planning on return to the UK whilst we sorted out the required visa for me to live over there permanently I couldn't find anything online about if I would have problems with this so I asked another website and was told the following;
"You can apply for adjustment of status (green card) after entering on VWP. Or, you can fly back to the UK to wait for your immigrant visa.
To stay in the US on VWP, you must get married after waiting 60 days after arrival. After getting married you have a small window of time to submit your green card applications, and after that you can wait here in the US for the green card interview and will not have to go back to the UK.
We have helped many clients get their green cards by entering VWP and marrying a US citizen subsequently. Usually money is the issue. US government filing fee for the green card is $1490 and the attorney's fees is $1800 (installment payments available)
If you decide to fly back to the UK and apply for the K-1 visa, be sure not to get married in the US, as that would terminate your eligibility for the K-1 visa, which is for fiance of US citizen."
The things I have found online have mentioned stuff about not being able to change the status whilst on vwp is what he said true? If not would I have any problems with my original plan.
