Hello,
This is my first time filing taxes so please bear with my questions and provide your support.
1. I am on F1 visa currently and has been working since Mar2010
2. I plan on filing 1040 NR EZ since I meet all the requirements set for filing the EZ version.
3. Since US has treaty w/India I am going to file Form 8833.
4. My employer withheld Social Security and Medicare taxes during last year, I will add the form 8316.

Assuming I made 63k since March, what goes on the Line 6 of EZ form (total income exempt by a treaty item J(1)e? How can I find that amount?)

Form 8316 reads "Information regarding request for efund of Social security tax....." what form is used for Medicare tax refund?

Is there any consolidated link where I can follow stepwise guide to filing NR taxes?

Thanks in advance
AV

1. You file Form 8843 (not 8833). Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents (http://taxipay.blogspot.com/2008/03/us-tax-filing-requirements-for-non.html)

2. For getting back FICA taxes, you file Form 843. It is not filed with your tax return. Your U.S. Tax Return: Social Security and Medicare (FICA) Taxes for Non-resident Exempt Individual (http://taxipay.blogspot.com/2008/03/non-resident-exempt-individual-social.html)

Hi MukatA,
Thanks for your reply. I filed my federal and CA taxes using turbo tax by mistake, but then I realized I can't use turbo tax. My question is can I still file for FICA taxes ? Doesn't filing taxes using turbo tax puts you in dual status category?

Thanks again for your guidance.

You will not get back FICA taxes if you file Form 843.
For federal you must first file amended tax return Form 1040X with properly done nonresident return and Form 8843. Wait for about 3 months. Then file Form 843 to get FICA taxes.
Your CA return will not change.

Thank you MukatA,
Just one last question, is there any form for State income tax return?
You mentioned I am also eligible to get CA state return.
Also,
Form 843 doesn't have provision for bank info.Since they are filed separately I assume the taxes are returned separately as well. So how would I get this amount back?
Thanks a lot,
AV
