I am a single mother to 5 children I have been separated from there father since 2005 and have received no child support from him what so ever! Yes, you have to go to court to apply for sole legal and physical custody. If you can prove the father is a danger to the children you may be able to get his rights terminated.

I agree with the other two answer you can ask the court for sole full custody, and explain to them how you feel that your kids may be indangered. And try and get proof of the threats he's been making to you, the more proof you have the better chance you have.
