Hi I have worked as a research fellow on J1 visa and have filed Form 1040NR in 2009 and 2010. I was wondering if I am allowed to file with Form 1040 as a resident alien this year?

Yes, you are exempt from residency for two years only. In the third year, you are not exempt. Your U.S. Tax Return: The U.S. Visas (http://taxipay.blogspot.com/2008/08/us-visas.html)

Hi,
Thanks a lot for the reply.
If I am filing as a resident I can claim my wife and my daughter as dependents right?
Also I have returned back to my country as of August 2010 does that make a difference?

Yes, it makes a difference if you left US in 2010. You are either dual status or nonresident; you are not resident for 2010.
When did you enter US?

Hi;

I was in US since July 2008 and left on July 20, 2010. Should I file as dual status? Is it any different than filing as a resident? I thought both used the same form 1040?
