View Full Version : Child custody and relocation in New Jersey

I have primary physical and residential custody of my son. His dad has joint decision making. My son is 14. I need permission to move out of state, and he gave it to me, we have always gotten along and try to avoid court. Now right before I'm leaving he is giving me a problem, I have no job in NJ as of 2/18 and I am starting a new job in PA in March. I need to be out of my house in NJ by the end of February. Now I am a few weeks away from going and he is trying to delay me. I will not have a job or anywhere to live, I can't stay here and I don't know what to do to at least get this into court quickly, I was told the docket is already out until March and I don't have that kind of time. If anyone can give me advice or knows how I can at least get a temporary emergency hearing I would appreciate it. Thank You.

What is the issue that is hanging you up ?

I told him a few weeks ago & he was fine with the move. Now that I will be leaving in about 2 weeks, we're packed up and Im going to be starting a new job, he is saying I can't leave with him. Now I need to get into court fast and don't know how to go about it because I was told the docket is already out into march sometime, and I'm supposed to be in my new house by march 1st. I don't want to get in trouble for leaving anyway, but I don't have a choice now, because he decided to pull this on me last minute.

Yes, and previously you had a written signed agreement ?
But of course unless it was submitted to the judge and approved he is allowed to change his mind up to the date of court and judge rules on it.

What Im still not getting is. What about the move is it that he doesn't like or approve of that he may have previously agreed to?

All of a sudden he is saying it's bad enuf he doesn't c our son that much as it is, through fault of his own. He tried saying he wants our son to finish school where I live, but my son can't finish school here even if he stayed with his father because his father doesn't live in the town where my son attends school. I already checked and they said no. Now he said he's going to c a lawyer, meanwhile Im supposed 3 b leaving the end of the month, and now he is trying to ruin everything.

Do you have any proof he agreed to the move?

So let the kid stay with his dad until the hearing.
