View Full Version : Temporary custody orders ever overturned?

Mom was given temporary primary joint custody. We are devastated. She has hardly cared for them since they were born. Dad had graphs for the last year detailing who had child when. She averaged 24% for the year. Paternal grandma had them about 40%. They Never married, he was never on birth certificate (he had a large scholarship that he would lose if they knew he had children. She makes a wonderful first impression, but is really an awful person. I thought he should attempt to get on birth certificate before final (90 days) but his lawyer says they can do it after final. I think it looks bad. Otherwise he lied about being a father to continue a scholarship so he could better take care of his child. We have decided to go with a jury trial, we are afraid to go before this judge again. What is the likelihood of overturning this decision? To many people have told me he has already lost - We are also going to hire an amicus attorney hoping they can see through this mother. Any suggestions or hope?

Temporary is just that, it is often changed or modified when they reach a final.

Next what are the terms of the "joint" what percent will each parent have child.

His lying about being the father for the scholarship will hurt him, and I would say hurt him worst in front of a jury, he was deny his child for money,

Sorry but to me ( and I may be one of those people on a jury) being a poor mom but still being there is not as bad as someone who deny child for money.

I would stick with the judge personally, unless you have something really bad on mom

I feel the judge has already made his decision. We were in court for 5 hours for the temporary decision. Dad has "standard visitation" About 25%
He thought maybe it would not look so bad because he was trying to get an education to better provide for the child. He had already accepted the scholarship when the children were born, but he did lie by omission. We know a lot of bad things about mom, but very difficult to prove them - She doesn't bathe or feed the child properly. She also has an older child that has lived with the paternal grandmother for over a year now - she claims she sent her there because they lived in a bad school district. Actually the child was about to fail because she had missed so much school because wouldn't get up to take her to school. Yeah, I hope you aren't on the jury.
