View Full Version : Will I get more returns with 1040 NR than 1040 ?

Hello,

I am Indian citizen and Single,working for Indian company.

I was on a deputation to US on L1-A VISA on a project assigmnet in TX between March 2011 and August 2011. Total stay of around 160 days.

Could some one help with following:

1. Can I appy as non resident alien ( as stay less than 183 days )?

2. If I apply as 1040 NR instead of 1040 will iget more returns.

3. Now am in India , how can I apply , manual or online?

4. Since my taxes are deducted in India, Can I recliam the Federal and SSN taxes back

You can only file nonresident tax return Form 1040NR or 1040NR-EZ. You can deduct travel expenses. Travel expenses include transportation, lodging and meals. Use Form 2106 or 2106-EZ to figure your allowable expenses that you claim on line 9 of Schedule A (Form 1040NR). So, that allows me for standard deduction of $5,700 and personal exemption of 3,600 too. In addition to travel expenses.

Or can I apply 1040 now as I will be travelling in 2011 to US again for the remaining year.
