View Full Version : Who shovels the snow, landlord or tenant?

I rent an apartment in a New Jersey multi family house.
We are having issues with our landlord concerning the clearing of the snow from the drive way.
He does come to clear it, but there is no telling when he'll do that, sometimes we are left with a choice of staying stuck at home, unable to drive our cars, or to take care of it ourselves.

Whose legal responsibility is it? Our lease doesn't state anything about it, and during summer he sends workers to take care of the yard -so I understand that's his responsibility.

Can we demand that he comes to do it in a certain time frame? Where can I find some formal information about that? I need to confront him and get to some sort of an agreement with him.

What's the Lease agreement say about it... you can't assume anything. Unless it says he will do it, then its your problem. Even if the grass gets cut... doesn't mean you get off the hook for shoveling your own snow. I have a friend with a house up the street he rents out to to a family... he takes care of the landscaping... but the tennents are responsible for shoveling their own snow.

So it sounds like he does clear it, just not as fast as you want.

So if you need out and it is not clear, then clear it,
