We have a commercial lease agreement and paid our rent but need to pay feb. today is the 1st of feb. can we be served a 3 day pay or quit?

If you don't pay on time, you can be served with a notice to pay or quit. As far as whether it would be three days or not, that would depend on which state you are in.

ANY question on law needs to include your general locale as laws vary by area.
If your lease states rent is due on the 1st, then on the 2nd you can be served with a pay or quit notice.

Yes unless the terms of your lease give you a late option.

This is a commercial lease so residential rules do not apply. Unless the lease specifically states that a pay or quit notice is required, the landlord DOES NOT have to give you a pay or quit notice. You have to carefully read your lease to see what it says about non-payment of rent. In many cases the lease will give you a 5 or 10 day grace period before a late fee is charged. However I have seen many leases where there was no notice required and a landlord could file a lawsuit for eviction as soon as payment was late.
