My husband and I have not lived with each other yet 2010. I live with my parents tough I file my own taxes my dad does not Claim me. Can I file single on my Taxes?My Husband has a SSN, and went to school in the US, is a non-citizen though, and is living back home . Thanks

So can I file as single? And If I file married does my dad file on his taxes that he has married person living in the house?

Are you are U.S. citizen or resident? When did your husband leave U.S. Did he file 2009 tax return.
Since you are married, you can only file as married filing jointly or married filing separately. You can be head of household if your husband is foreign person and did not live with you in U.S. and you have a qualifying dependent. I assume you have income to file a return againt. If so, you will file as Married Filing Separate.

If your income is not too high, the tax would be the same as if you filed SINGLE.
