View Full Version : I was summons by hand delivery but was given someone else's paperwork not mine.

Someone served me with papers for unpaid medical bills in Colorado. Do you know the limitations on medical bills? Also, they served me these papers when I was not home and gave them to my oldest daughter. She in turned set them on the counter and when I got them, I noticed that the paperwork did not have my name on it. It was someone else paperwork. I called the number on the paper and the girl sent me to another number which was the so called "Legal Office". The lady told me she would need to talk to her boss and call me back on what to do. Then I got a call from the collection agency who asked me my name, phone and address then told me that it was given to the wrong person. She told me she would pick it up and I told her no, I will mail it back to her. I wrote down names and times I spoke to everyone about this and made a copy of the summons that they gave my daughter, just in case there was a court date and they really did give someone else my paperwork. Is this summons legal if it was not mine? What should I do about this?

I don't know what you mean by the limitations on medical bills. Do you mean the time frame within which that unpaid debt has to be placed in suit or something else?

A summons is a legal document; however, it has NOT been legally served (if that is your question). What would I do? I'd send it back with a letter, copy to the CORRECT person, stating that you had been served in error. There is always a possibility that the process server will file an Affidavit of Service, not realizing service was not made.
