Hi,
We had a baby on June 30, 2010 in India. Me, my wife and my baby came to the US on Sep 21, 2010. I am on H1 visa, while my wife and baby are on H4 visa. My wife and I have resident alien status based on the number of days stay, but I am confused about my baby.
She fulfills all the criteria for "Child Tax Credit", but I don't know if she is to be considered a resident alien or not. From what I have read, she could be in resident alien status due to 2 reasons:
1. I have read that newborns are considered resident aliens (newborn is credited with spending the entire year with their parents).
2. Since this is her first year in US, she could be considered a dual status alien. We could choose to have her treated as a resident alien in 2010, if she fulfills the resident alien conditions in 2011.
Would the resident alien status also affect her status for being claimed as a dependent on my "married filing jointly" tax return?
