My son is 17 years old not working and has been told he is the father of a baby due in February to a 20 year old woman who he slept with a few times but was not in a relationship with. She has said she will not allow him to see the child when it is born, is there any way my son can take her to court for a paternity test as she will not do this willingly so he can get access to his chid?

He needs to get a DNA test to prove he is or isn't the father. He should NOT admit to anything without the test results.

And yes... as the potiential father, he can petition the court to get it.

After all... she might know its not his (thus her reluctance)... and more than a few women have falsely accused men of being the father ( looking for money) when DNA tests prove otherwise.


THe flip side... once it is established he is the father... he is going to be paying for it until the Child reaches adulthood (besides the parental involvement if there is any). Even if he is unsuccessful in his bid for custody. If DNA test proves he isn't... then I hope it's a lesson he has learned well.

It does not matter what she wants or says, you and son should not be fighting with her over it now. When child is born, your son files for visititation and asks for a DNA test, he will be ordered to pay child support.
