View Full Version : Help about to lose my fiance-!?

My boyfriend has had previous felonies and served 3 years in prison and 1 year in a immigration jail. Recently my fiancé was released from a immigration jai. We thought he had served his time. Several months went by and at one of his routine check in with immigration/porole he was immediately take back into custody, where he has been for the past couple of months. Nobody will give us any information on why he was arrested again or even any information/advice. His deportation officer has not return any of my calls and he has not been given any information as well. It is as if he has no rights? We are afraid he will be deported without me ever knowing or get an opportunity to fight it. I am a single mother to his 2 children, with a meager income. I can't afford an attorney. If anyone has any advice it would be apperciated. We live in California and he was a temp citizen on a visa which now obviously has been revoked. We would like to get married but can't not even find anyone to help with that and if it is even an option. Thanks for your time and again any friendly advice is most apperciated in this very distressing time. Many Thanks Again!! By the way he is from Haiti.

It's hard to believe that they didn't tell him why when they took him back into custody, but I suppose it's possible. (Maybe they don't like his past, or maybe he's not telling you the whole story.) He doesn't have all the rights a citizen has; you don't 'serve your time' and then assume you are free if immigration laws change. There may have been changes in the last year reflected by his felony record. Immigration law is complicated enough without every detail of his crimes, so I think you do need to pay a lawyer, sorry.
