Hi,

I have graduated in dec 2009 and I am on Post Completion OPT and employed as an independent contractor on 1099 basis for five months i.e from (May 2010 - Sep 2010), and then changed to W2 from oct 2010 onwards. I did not file for taxes on 1099 also. So can you tell me how to file for taxes, as I am self employed as an independent contractor(1099 basis) for 5 months then as W2 employee.

You will file a non-resident alien tax return (Form 1040NR with Schedule C) to report the Form 1099 income. The W-2 income will be reported on Line #7 of the Form 1040NR, and the Form 199 income will be reported on the Schedule C, on which you will also deduct valid work expenses incurred while working as an independent contractor.

No self-employment tax (Schedule SE) is required due to your non-resident alien status.

You also need to file Form 8843.
