How old is your son? How old is the child's mother? If they are both over the age of 18, there's not much you can do. You are the grandparent, not the parent.

Your son can petition the court to obtain more visitation time with his child.

It all depends. Typically the court doesn't like to allow for overnight visitation until the child is older. However, the mother is a child herself and this further complicates things because your son shouldn't have been having sex with her in the first place.

Is your son listed on the birth certificate? Has he been established as the legal father?

YES we know this he has a case already but not by her parents a distant family member pressed charges on him when they found out about their relationship but that has nothing to do with him being the child's listed father

A family member can't press charges; a court of law can. And you're right, that has nothing to do with him being the child's father or not.

So is he listed on the birth certificate or not?

yes he is

Then he needs to petition the court for joint custody and shared placement of the child. Without a court order, he cannot force her to do anything.
