View Full Version : What are my rights? Move in day the apartment is filthy with bad appliances

I moved in apartment 2 weeks ago and found the apartment to be in a state of disgrace. Unclean, appliances in bad condition, roaches crawling around, bathroom fixtures in disgusting manner. It was obvious that the apartment was not ready for move-in yet the landlord allowed me to move it. I have complained to manager who dismissed it and claimed that she didn't think anything was wrong. I persisted and asked the receptionist to come upstairs and take a look and she was horrified. Eventually with my persistence the manager, finally agreed to do some things but wanted to wait until she returned from her vacation. The maintenance contractors were also bitter and really did not want to do any work. So now 2 weeks later some items are being worked on, still not completed.
I think this is outrageous that she did not have the apt ready before move-in. However, she took my rent and security deposit.
I would like remedy by refunding or giving me credit for the length of time it takes for the apt to be in an acceptable move-in condition.
Would you please let me know what my rights are and how to go about enforcing that and what if I receive negative the repercussions from the landlord? Thank you for your advice.

You had the right ( was there a lease ?) but you had a right not to pay any rent or deposit until the apartment was correct and not move in.

So when you moved in, you basically accepted the apartment

So move out and find a better place

Even if you are buying a house you do a final inspection before closing. You saw it in it's current state with what, promises? You need them in writing. You could call the Health Dept about the roaches. But even they are going to be slow to act at this time of year.
If you want to pursue this on legalities take lots of pictures and put rents into escrow with a lawyer.
