MY husband and I was living in apartment in new jesey for past 3 years we have a written lease agreement ends in 2008.It says nothing about the period of time(like 30 day notice) about a moving out notice.now its month-month lease. Landlady takes a lot of time to do any repairs there like from 2-6months.we decided to move last month , tried togive verbally on phone throughout November 1st week.she didn't pick up our call as usual,at last she picked up call and agreed to give our deposit back, when we move.. before we moved out we called her to come and take a look at the apartment, she said she cant, she will do it later.. so we moved out on dec1st,cleaned the whole house,no damages done, paid nov rent.then after a week when we called her for our security deposit, she told us we gave a short notice and she's taking our deposit. We decided to go small claim court.my question is that is a verbal move out notice is valid in New Jersey.

NJ law requires a written notice of your intent to terminate your tenancy. You can read all about NJ landlord/tenant law at http://www.nj.gov/dca/divisions/codes/publications/pdf_lti/t_i_r.pdf
