I'm a 26 year old female I recently was fired from my job a retail department store for stealing 500 dollars out the register between the months of October and November. I plan on speaking to the judge a day before my court day. Will I go to jail for this? The stores loss prevention team advised me a few times that I will not face jail time but I have no money to repay them at this point and I hope to have at least half by my court date. What do you think will happen to me. I understand what I did was wrong, but I was using the money to buy my mothers prescription who is near death in the hospital. I don't want to go to jail. Do you think the judge will give me jail time?

People who are in the hospital don't need other people to buy them prescriptions. Lame excuse. Can't you think up a better one?

And as for speaking to the Judge the day before you go to court won't work either as he won't speak to you.

You need to speak to your court appointed attorney or your private attorney about this. You will probably get probation and Court Ordered restitution which you will have to pay regardless.

You are not allowed to "talk to the judge" outside of the court. If you ( and I hope you have an attorney) wish to talk to the DA and make a plea deal before court, that is what you do. They judge does not even speak about sentences until you are convicted.

If this is a first offense, most likely they will allow probation and a payment plan to pay the store back. But agreed, either don't testify, or tell the truth, or at least a lot better story than sick mom in hospital

Yes I actually went to the court today to speak to the judge about another matter and the sheriff officer suggested I come back the next day on my appointed date because I had to catch my class.

I was told to speak to the judge on the days court is in session. The clerks at the window suggested I come in

You must live in a very small community as most if not all judges do not speak to people other than attorneys when they are not in court.
