My wife and I have leased our apt. for 4 years.In April of 2010 the management told us there was a problem with our cigarette smoke drifting to the upstairs unit because of a faulty ventilation in the building.They said it bothered the past two tenants so much they had to let them out of their leases.They told us they would find us another another apt. in the complex and only once did they call us an about an available unit.When we returned their call, suddenly the manager was on vacation and we were told that the apartment was not available.We've always paid rent on time and as far as I know there have been no complaints about about us being bad neighbors.Lease expires 01-31-2010.Not quite sure about this under Georgia laws.

Legally they don't have to renew your lease. Better start looking for a new place to live. In your next apartment you may want to invest in an air purifier so that your smoking does not annoy the other tenants. If landlords don't want to renew a lease they are not legally obligated to even if you want to renew the lease. It's a two way street.

Have they given you notice of non-renewal? What does your lease say about the amount of notice needed?

Bottom line is they don't have to renew.

They do not have to have a reason to non renew your lease in GA. *** also I will assume you man 1/31 of 2011 since 2010 has long passed.

But the terms of the lease will apply, on notice not to renew
