View Full Version : Can the non-U.S. Couple get divorced in a foreign country when married in Hawaii?

My friend and the husband, who are both non-U.S. citizens, were married in Hawaii. Now they plan to get divorced. They are currently living in the Western Samoa. They have never lived in Hawaii as a married couple. Are they required to report or file a divorce with the State of Hawaii? Can they get divorced in Samoa and that would be it? Thanks for help.

No.

I suspect that U.S. state courts would recognize a Western Samoan divorce decree particularly when both parties are WS residents.

Thanks so much for your comment. Actually my friend is a Japanese national, but I suppose the answer would be same.
