View Full Version : How do I actually file the motion in Superior Court in Gwinnett County, GA?

I have the necessary paper work to file the motion, I just don't know how to go about actually doing it.  It asks for a case number at the top of the motion and since it is new there is no case number, do I have to go to the courthouse?  I live in Ohio, but am filing contempt against my ex husband who still lives in Georgia and that is where the divorce was done.  I just don't know what to do next.  I guess I just need to know the procedure to file it, I have the paper work... help?

If he's in contempt of a court order from your DIVORCE, then that's the case number...  
 
You're not going to learn how to write and file your motion here.  I suggest you write your motion in the form of a plain language letter addressed to the court.  Make copies of everything and include it.  Send your letter certified, return receipt requested, and send a copy to your husband's lawyer or your husband himself.
 
If the court doesn't like that method, they'll tell you.
